The purpose of this document is to establish by MundialRooms the conditions that regulate the access and general use of this Web Site for all users, so that their access and use, will necessarily imply the submission and acceptance of these General Conditions of use, as well as, in case of formalizing the contracting of an accommodation booking service, will also imply the acceptance of the General Conditions that characterize such contracting (hereinafter referred to as General Conditions).

2.1 Access to the Web

The User must be of legal age, in accordance with Spanish legislation, and have the necessary legal capacity to contract the services offered on this Website. In case of contracting by minors, the authorization of parents or guardians will be required to hire the service.

Access to this Web Site is free and free of charge. It is understood that by accessing and / or the mere use of the Website, gives the Client / Resident the status of User (hereinafter, the User), which implies adherence to this Legal Notice and General Conditions. Consequently, MundialRooms recommends the User to read carefully the terms and conditions of use collected by the owner of this page each time you access the Website.

MundialRooms informs that for access to certain content offered by this website, such as the formalization of a reservation of accommodation, the user will have to provide certain personal data to complete any booking form, as well as for the recruitment of any of the services offered on this website.

Also, the accommodation booking service and other services managed by MundialRooms through this website, are regulated by these Terms of Use that integrate and complete the Legal Notice.

2.2 Use of the Website

The User agrees to use the Web Site diligently, correctly and for lawful purposes and, in particular, undertakes to: refrain from using the contents and information of MundialRooms obtained through our website for purposes or effects contrary to law, morality and generally accepted good customs or public order, to refrain from reproducing or copying, distributing or allowing public access through any form of public communication, transform or modify the contents of this Website, unless you have permission from the owner of the corresponding rights or it is legally permitted. In particular and by way of example and not exhaustively, the User undertakes not to capture data for advertising purposes, not to send any type of online advertising or chain messages and not to transmit or disseminate to third parties through the Services provided by www.mundialrooms.com, information, messages, image files, photographs, software and in general any kind of material, data or content that:

incur in illicit, illegal or contrary to public order activities,

Users of the website www.mundialrooms.com, owned by Datema, S.L., are informed that it obtains the data of its clients and users through the reservation form that must be filled out in order to contract the services provided by MundialRooms through this website. Thus, the data that MundialRooms has, are those data provided by the Clients/Users at the moment of the formalization of the reservation and in its case, of the contracting.

MundialRooms informs that for access to certain content offered by this website, such as the formalization of a reservation of accommodation, the User will have to provide certain personal data when completing any booking form, as well as for the hiring of any of the services offered on this Website. These data must be truthful, accurate, authentic and current. MundialRooms will give these data the corresponding automated treatment according to its nature or purpose, and in the conditions and terms indicated in this section. And this merchant may store and save the data provided in order to maintain the contractual relationship with the customer / User.

The purposes of the collection of personal data are those that are particularly indicated on each of the pages where the booking form appears (data registration). With regard to the personal data collected from registered users, they will be used for the purpose of adapting the products and services requested by the User to the preferences indicated on the form. In general, the personal data you provide will be used to respond to your request for information and reservation of a place, as well as subsequently and in particular, for contracting with the Client/User. The consent for the communication of personal data by the Client/User is revocable at any time, although it will not be retroactive.

3. General booking and contracting conditions

Access to this website is free, although some of the services and content offered by MundialRooms to third parties through the Website, may be subject to prior contracting and payment of an amount, which will be expressly specified in their own conditions of contracting. It is understood that by accessing and / or using this website, the Client / Resident will acquire the status of User (hereinafter the User), which implies adherence to this Legal Notice.

The function of this website is to provide users who access it, the different services offered and provided by MundialRooms through the same. The purpose of these Conditions is to regulate the general conditions of the reservation services for accommodation, houses, studios, apartments and rooms and their contracting through this page owned by MundialRooms.

The use of these services, will suppose the full acceptance and without reservations, and the validity of each and every one of the General Conditions of Contracting. MundialRooms informs that the procedures to obtain the provision of the services offered are those described in these General Conditions of reservation and contracting, as well as those other specific or promotional services that are indicated on screen during navigation, so that you declare to know and accept these procedures as necessary to hire the services offered on this website.

MundialRooms reserves the right to modify unilaterally and without notice, any of the points contained in these General Conditions in the manner it deems appropriate, informing users of the changes made through the Website, so that they can be known and again accepted by users.

If one of the stipulations of the present General Conditions of reservation is declared null and void or inoperative, the rest of the General Conditions will be maintained in the agreed terms.

Access to the Website by minors is prohibited, unless they have the prior and express authorization of their parents, guardians or legal representatives, who will be held responsible for the acts carried out by the minors in their care, in accordance with current regulations. In any case, it will be presumed that the access made by a minor to the Website has been made with the prior and express authorization of their parents, guardians or legal representatives. The User must use this service in accordance with the Law, morality, good customs and public order, and in accordance with the provisions of these General Conditions of online booking. Consequently, it is obliged not to use these services for illicit purposes and/or contrary to the established in the present General Conditions, harmful to the law and/or against the interests of third parties or that, in any way, may damage the services of MundialRooms and/or its image.

MundialRooms and the user, are subject to the jurisdiction of the courts and tribunals of Madrid for any controversy or conflict that may eventually arise from the interpretation of these Conditions as well as access or use of this website.

3.1 Use of the accommodation booking service

MundialRooms is dedicated to the renting of houses, studios, apartments and rooms exclusively to students or young professionals between 18 and 37 years old. The company is specialized and focuses its activity exclusively on the accommodation of this profile of tenant, being out of its scope of action the renting of any type of property to people who do not meet these age requirements and can not provide the documentation that will be detailed later in point 3.3.3 Booking Process and Reservation Request.

The User who is interested in staying in our rooms must fill in a reservation request form with his/her personal data. The purpose of this service is the reservation of a room, house, apartment or studio for a specific period.

The User who accesses this service must be of legal age, in accordance with Spanish legislation, and have the necessary legal capacity to contract the services offered on this Website by himself/herself. In case of hiring by minors, it will be required that parents or guardians are the ones who formalize the reservation (fill in the booking form) and hire the accommodation service.

In general, the personal data you provide will be used for the correct management of the reservation of the place, as well as subsequently for the contracting with the Client/User. Consent for the communication of personal data is revocable at any time, although it will not have retroactive effects.

The data provided by the User will be used to respond to your reservation request and to adapt the products and services requested by the User to the preferences indicated in the reservation form (data registration) and will involve the use of your email address to receive any communication from MundialRooms. To start the reservation request process, the User will have to access the reservation form and fill it with your personal data along with other data requested by tabs in the same for the proper provision of the service, and once completed, you can not send the form if the interested customer has not previously and voluntarily accepted the pre-registration conditions, whose wording is recommended to any User to be read carefully before acceptance.

After completing the pre-registration form, the User will be sent an e-mail with all the data entered in the Form.

3.3 Conditions of Reservation, Contracting a Place and Duration of the Contract

3.3.1 Formalizing the process of requesting a place reservation

The User/Client will fill in an online form with his/her data for reservations of houses, apartments or rooms, in which a check box will appear at the end with the general contracting conditions of the reservation, so that they can be accepted by the Client if he/she agrees.

Once the User has filled in all their details, they will automatically receive an email at the address specified on the form, with instructions to complete the process. This is the email that will be used for all subsequent communications with MundialRooms. To formalize the reservation request, it is essential to make the payment of the reservation request by credit card at the end of this form. Otherwise the request will be rejected.

The user/client must use this service in accordance with the Spanish legislation, morality, good customs and public order; and in accordance with the present online booking conditions for the houses, apartments or rooms managed by MundialRooms and in the General Conditions of the Contract. Consequently, you are obliged not to use these services for illicit purposes and/or contrary to what is established in the present conditions and in the General Conditions of the Contracting, harmful to the law and/or that attempt against the interests of third parties or that, in any way, can damage the services that MundialRooms provides and manages and/or its image.

3.3.2 Duration of the Accommodation Lease Agreement

Depending on the type of accommodation, the rental contract will be signed for a minimum period of six months and a maximum of one year. For rooms the minimum stay will be six months depending on the time of year in which the reservation is made, and may have variations depending on the availability of the website. For the houses the minimum stay will be of one year of obligatory fulfillment.

However, this period may be agreed with customers depending on the availability of homes, apartments and rooms.

The entries made in the period from 1 to 15 of each month will pay the full monthly fee.

Entries made in the period from the 16th to the 30th/31st of the month will pay a fortnight, with the exception of reservations requested for those accommodations that are already available in the first fortnight of the month. In the latter case, the full monthly fee will be paid.

3.3.3 Recruitment Process and Reservation Request

After completing the booking form with your personal data and so that we can book the place, the user must check that it meets the requirements of customer profile and the type of accommodation chosen. If you meet the requirements, you can confirm the dates of entry and exit, you must read and accept the terms and conditions of the reservation and make the payment by card in our 100% secure payment gateway, with SSL certificate. To book the chosen property you must pay the amount indicated in the booking process as a deposit. You will receive an email confirming the processing of your booking.

Booking process:

1.Once the card payment has been made, the user will receive an email confirming the processing of the booking. This email will be received within 24 working hours or 72 hours if the booking is made on weekends or holidays. In this email the following documentation and information will be requested:

In case of students

NIF, NIE, Passport or ID of the person making the reservation and who will be the holder of the rental contract.

Enrolment in a study centre

Joint guarantor (father, mother, guardian,...). The documentation and information to be provided by the joint guarantor is as follows:

• NIF, NIE, Passport or ID number.
• Permanent employment contract and the last three payslips or bank statements. In the case of self-employed, the last income tax return and statement of accounts.
• Contact details: home address, telephone and email.

In the case of young professionals:

NIF, NIE, Passport or ID of the person making the booking and who will be the holder of the rental contract.

Permanent employment contract and last three payslips. In the case of self-employed, last income tax return and statement of accounts.

If the work contract is an internship or temporary contract: Joint and several guarantee (father, mother, guardian, …). The documentation and information to be provided by the joint guarantor is as follows:

• NIF, NIE, Passport or ID number.
• Permanent employment contract and the last three payslips or statement of accounts. In the case of self-employed, last income tax return and statement of accounts.
• Contact details: home address, telephone and email.

Before making the reservation, the user must ensure that they meet the requirements of the tenant profile and that they are able to provide the documentation and information that will be requested for processing.

In the case of renting apartments and complete dwellings, the documentation requested for each of the persons who are going to be holders of the rental contract must be provided.

All documentation must be sent to reservas@mundialrooms.com .

2. MundialRooms staff will review the documentation provided and will make a risk assessment. If part of the documentation is missing or the documentation provided is not sufficient, an advisor will contact the user to indicate the steps to follow in order to confirm the reservation. Therefore, it is important that the user checks that the contact details provided on the booking form are correct.

After the assessment of the documentation received by the risk department, within 24 working hours and 72 hours on weekends and holidays, the user will receive an email confirming the booking of the accommodation, if the documentation sent has been approved. In this case, the rental contract will be sent and, if necessary, also the guarantee document for signature. If, on the other hand, the documentation provided is not approved, the user will receive an email cancelling the reservation and will be refunded the full amount paid as a deposit for the reservation.

3. In the booking confirmation email the user will be asked to pay by bank transfer the amount of the deposit of the property, equivalent to one month's rent, the current month's rent and, if applicable, the additional security deposit, also equivalent to one month's rent. You must also pay by bank transfer the amount of the agency fees, equivalent to one month's rent plus 21% VAT. From the amount of the agency fees the user must deduct the amount paid as a reservation deposit.

When the client makes the transfers, he/she must send the payment receipts to reservas@mundialrooms.com and, once they are made, we will notify the formalization of the reservation.

4. The signing of the contract and handing over of the keys takes place in our offices at Pº. Infanta Isabel, 23 Local 3, 28014-Madrid, from 09:00h to 14:00h and from 16:00h to 19:00h, from Monday to Friday, except on public holidays.

The user must provide MundialRooms the information of his arrival at least 72 hours in advance to be included in the agenda and to be ready at the moment of the check-in. Before check-in you must have made all payments: deposit, first month's rent, agency fees and, if applicable, additional security deposit. It is an essential condition that all payments have been made before the keys are handed over.

The main language of the contracts will be Spanish, without prejudice to its translation into English as a secondary language when circumstances require it. In case of discrepancy, the Spanish version will prevail.

3.4 Admission and allocation of places

The complete flats will be destined for exclusive use of housing, not being able to develop in them any type of business or activity of industrial type or annoying, unhealthy, noxious, noxious or dangerous activities in the building.

All our rooms are for individual use and only the person making the reservation can stay in them. If you require a double room, you must specify it at the time of booking. Double rooms are subject to a price increase over the price of a single room. In any case, it is compulsory to respect the established occupancy limit.

3.5 Lease Renewal/Extension

Customers have the possibility to request the extension of their stay in the same apartment and room, (within the contractually established period which will be sixty days in the case of rooms and thirty days in the case of houses) and can extend their stay within the minimum periods established in the application, which will vary depending on the end date of the initial contract. MundialRooms, will send informative mails indicating the faculty of the client to proceed to the extension of the contract and the terms in which it can be carried out.

Out of the established term for the renewal (60 days rooms-30 days housing), MundialRooms, will advertise the stays through its web not being able to guarantee the accommodation in the same location. Nevertheless, the Client can also request the extension of his contract, reserving in this case MundialRooms the faculty to reject the renewal depending on the availability of the housing or the room, which will communicate to the Client in a term not superior to five days from the request.

In the event that the Customer chooses to extend his stay, he must review and accept these conditions of renewal. The extension contract will remain attached to the main contract, being considered a non-extinguishing modifying novation, except for the duration, which will be governed by the stipulations of the extension and in any case of obligatory compliance for the parties, without the possibility of early termination. In this sense, the Client and the Agency are obliged to comply with the full period of the renewal, except by mutual agreement of the parties. In the event that the Client terminates the contract unilaterally, he/she will lose the right to the refund of the deposit and will have to pay the outstanding rent until the end of the contract as a consequence of the damages caused.

If the client has any outstanding rent payments, supply costs or due to penalties or damages, he/she must regularize the situation for the extension to be effective, otherwise the stay cannot be extended.

The formalization of the renewal will be carried out in the offices of MundialRooms or by telematic way with digital signature, proceeding to the corresponding payment in its case, once accepted the terms and conditions of the contract.

The deposit initially provided will continue to be valid when the renewal is made, and will be returned at the end of the extension, once the state of the property or occupied room has been verified and as long as the obligations inherent to the contract have been fulfilled. If the amount of the rent is updated according to the CPI or by the official index that replaces it in the manner established by current legislation and its amount is increased, the customer must match the amount of the deposit to the updated rent.

4. Cancellation and refund policy

The costs of cancellation of reservations will be as follows:

Notifying more than 60 days prior to the check-in date, only the management costs/fees will be paid and MundialRooms will reimburse 100% of the deposit and other amounts that had already been paid for other concepts.

Notifying between 30 and 60 days before the check-in date, the management fees and 50% of the deposit will be paid. MundialRooms will reimburse the remaining 50% and other amounts that have already been paid for other concepts.

Notifying less than 30 days before the check-in date, MundialRooms will not refund neither the deposit nor the management fees, as well as any other amount paid for other concepts or services requested.

Cancellations are not allowed during the occupation and, in case of cancellations, the total amount of the deposit will be lost, regardless of what is established in the contract.

4.3 Deadline for the return of the reservation payment

Refunds of reservation payments will be made within 10 days.

5. Transaction security, SSL certificate

The contracting of the reservation services offered by MundialRooms on the web can be made through the Virtual POS, the payment of the reservation signal is made in a secure environment through the implementation of a data encryption system SSL (Secure Sockets Layers) that guarantees the protection of communications via the Internet with it. The Client/User can check that he/she is in a secure operating environment by observing the closed padlock at the bottom of the screen.

The User agrees to make lawful and appropriate use of this Website and the services provided by MundialRooms, in accordance with this Legal Notice and not to develop activities contrary to law, morality, public order and in general, to make good use of these conditions.

MundialRooms reserves, in case of carrying out any activity contrary to law, the right to cancel the reservations of any user or deny access to the Website, without prior notice, and to exercise the legal actions it deems appropriate. In the same way, MundialRooms guarantees that the server where personal data are stored and treated, has the necessary technical and organizational security measures to prevent, as far as possible, the alteration, loss and / or unauthorized access to such personal data.
